Wager - User Agreement
PLEASE READ THIS CAREFULLY BEFORE USING THE WAGER APP
1.1 The Wager application (the "App") is the official app of the peer-to-peer sports betting exchange operated by Cato Partners Limited (“Operator”, “we” or “us”). The App enables registered users ("Users" and, where you are a registered user "you") to place real-money bets ("Bets") with other Users.
1.2 We are registered in England and Wales under company number 11583047 and have our registered office at Commercial Unit 2, 124 East Road, London, England, N1 6FD.
1.3 This User Agreement and the documents referred to in it (together, referred to as the "Terms and Conditions") tell you the terms on which you may use the App and the services provided on the App (the "Services"). Please read the Terms and Conditions carefully before you start to use the App. By using the App you indicate that you accept the Terms and Conditions and that you agree to abide by them. At this point a legally binding agreement on the Terms and Conditions is concluded between you and us. If you do not agree, you may not use the App. Please also note that the Terms and Conditions are subject to change. The Terms and Conditions include the following documents:
1.3.1 this User Agreement;
1.3.3 the Wager Betting Rules; and
1.3.4 any terms, conditions and rules of any special offers, promotions or bonuses which may appear on the App from time to time.
1.4 When certain words and phrases are used in these Terms and Conditions, they have specific meanings (these are known as "defined terms"). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used, it has the meaning given to it in the section of these Terms and Conditions where it was defined (you can find these meanings by looking at the sentence where the defined term is included in brackets, bold font and speech marks).

2. Accessing the App
2.1 The App requires a smartphone or other mobile device running either the iOS or Android operating systems (the device you use, the "Device") and, to download the App and to access the latest features, you will need access to the internet and an applicable app store.
2.2 Access to the App and the services provided on it is permitted on a temporary basis, and we reserve the right to withdraw or amend the App and those services without notice, subject to the provisions of this User Agreement relating to open Bets and your funds. We will not be liable if for any reason the App is unavailable at any time or for any reason. We do not guarantee that the App, or any content on it, will always be available or that it will be uninterrupted.
2.3 We restrict access to some parts of the App to Users who have registered with us. We may suspend access to the App, or close it indefinitely, subject to the provisions of this User Agreement relating to open Bets and your funds.
2.4 Any market information, "tips" or live scores on the App are provided for general information purposes only. They are not intended to amount to advice on which you should rely and if you rely on this content you do so at your own risk.
3. Changes to the App
3.1 We intend to update the App regularly, and may change the content at any time. Any of the material on the App may be out of date at any given time, and unless otherwise required by law, regulation or these Terms and Conditions, we are under no obligation to update such material.
4. Your account
4.1 You are free to browse the App but, if you want to place a Bet or view any additional functionality, you are required to open an account with us (your "Account”) by completing the registration form on the App.
4.2 By applying to register with us you declare that:
4.2.1 you are at least 18 years old;
4.2.2 your place of residence is in the United Kingdom and you will only place Bets from the United Kingdom;
4.2.3 you have legal capacity and authority to enter into these Terms and Conditions;
4.2.4 you do not have any other account open on the App, and you are acting on your own behalf and not on behalf of anyone else;
4.2.5 it is not illegal to enter into these Terms and Conditions in the jurisdiction where you live and you will not lay or place any Bets in any jurisdiction in which it would be illegal to do so;
4.2.6 the information provided on the registration form is correct, including your name, date of birth and email addresses, and any other information used to authenticate your identity;
4.2.7 you are aware that losses can occur by placing Bets and you agree to be responsible for any such losses, and that (to the maximum extent permissible by law) such losses cannot be recovered from us under any circumstances (for further information about your legal rights, you can contact your local authority Trading Standards Department or Citizens' Advice Bureau or seek legal advice);
4.2.8 you are authorised to make any payments that you make as a result of placing any Bets and will at all times act in good faith in relation to those payments and to our services overall; and
4.2.9 you have read and understood the terms of these Terms and Conditions and agree to be fully bound by their terms.
4.3 As a consequence of your applying to register with us, you agree that we may verify your identity and the accuracy of the information provided on the registration form, including without limitation by requiring further information and/or proof of identity from you, and may pass your information on to third parties (including credit reference agencies) in order to do so. Failure to provide satisfactory verification information and/or proof of identity to us on demand may lead to your Account being suspended or terminated.
4.4 We reserve the right in our absolute discretion to refuse any application for registration and are not obliged to provide a reason for any such refusal.
4.5 If your application to register is successful then we will inform you that your Account has been created.
4.6 As part of the Account opening process you will be required to choose a username and password for your Account. You must treat your password and Account details as confidential at all times and you must not disclose them to any third party. If you become aware or suspect that a third party has access to your password and/or your Account details you must inform us immediately at email@example.com.
4.7 You agree that you are responsible for any use of your Account by a third party where such use is permitted or authorised by you or due to your fault or negligence. We are entitled to assume that any Bets placed using your Account have been placed by you, unless you are able to demonstrate to our reasonable satisfaction that use of your Account by a third party was neither permitted nor authorised by you nor due to your fault or negligence. We will not be responsible or liable to you for any loss that you may incur as a result of misuse of your password or security on your Device (for example touch ID), and we accept no responsibility or liability resulting from its use by a third party, where you are unable to demonstrate to our reasonable satisfaction that such use is not: (i) permitted or authorised by you; or (ii) due to your fault or negligence. We reserve the right to retain your funds if we believe you have allowed your account to be used by third parties with your consent
4.8 Your Account is personal to you and may not be transferred to a third party without our prior written consent.
4.9 You agree to inform us immediately of any change to your information as provided at the time you registered with us or as soon as you are aware of any mistakes or inaccuracies in the information that we hold about you.
5. Your funds: Deposits and Withdrawals
5.1 Before you can place a Bet, you must deposit funds into your Account by using one of the methods set out in under this section 5.
5.2 Before you can deposit funds you will first need to provide a postal address and register a valid payment card. Your card details will only be stored with our payment services providers.
5.3 The name on the card or the bank account or any other payment method should be identical to that of the Account holder. It is strictly prohibited to fund your Account using an account from a payment source that is not in your name, and it may be a criminal offence to do so. If we identify that funds have been deposited to your Account from a third party, we reserve the right to immediately return the deposit back to the source, void any winnings that have arisen from such a deposit, void outstanding bets and suspend or close your Account. Any charges levied by the banks and/or payment gateways will be deducted from the reversed amount. We further reserve the right to contact the police and/or make a disclosure to any other appropriate authority.
5.4 Funds deposited or withdrawn with us in your Account will show up as "Wager" on your credit and debit card statements.
5.5 Other than in the case of 5.3 above, we will absorb the cost of third party payment providers’ deposit and withdrawal charges by default. We do however reserve the right to pass on a percentage of the fees to individual accounts. If you fall into this category for additional deposit or withdrawal charges we will contact you beforehand.
5.6 You will not be entitled to place a Bet (this includes both sending a Bet request to another User and accepting a Bet request sent by another User) unless you have sufficient funds in your Account to do so.
5.7 Funds cannot be transferred from the Account of one User to the Account of another User.
5.8 If you reside in a jurisdiction where winnings are taxable, it will be your own responsibility to keep track of those winnings and report them to the proper authorities.
5.9 The amount with which you have available to place Bets is represented by your 'Available Funds' balance set out on the App. You agree to let us know immediately if you become aware of any errors in respect to the funds in your Account.
5.10 If you win a valid Bet determined in accordance with the Wager Betting Rules, your winnings will be deposited into your Account. Payment of any winnings may be subject to the successful completion of the process described in the "Verification Procedure" section below ("Verification Procedure"). Any funds/winnings credited to an account in error are not available for use, and we reserve the right to void any transactions involving such funds and/or withdraw the relevant amount from your Account and/or reverse the transaction, either at the time or retrospectively.
5.11 Your Account is provided only for the purpose of you placing Bets using the App. It is not provided for use as a banking facility. Money deposited in your Account will not earn any interest. If you appear to make deposits and withdrawals which do not relate to genuine Bets, we reserve the right to suspend and/or close your Account.
5.12 You may log in to your Account to view a statement of account which will show all transactions effected on that Account, namely deposits, bonuses, winnings, withdrawals and net deposits. You can view the status of all your Bet requests (i.e. Bets that you have received but you have not responded to and Bets that you have sent to another User but they have not responded), open Bets (i.e. Bets that have been placed but not yet settled) and settled Bets. Bets that have been rejected, voided or cancelled will be removed from the App after a period no longer than one week from the time when they were rejected, voided or cancelled. You can decide to withdraw part or all of your funds from your Account by selecting from the various options made available by the App.
5.13 The minimum deposit is £5. The maximum deposit is £1000.
5.14 The minimum withdrawal is £5. The maximum withdrawal is £10,000. We will attempt to process any withdrawal requests within five (5) working days from receipt of such request.
5.15 You acknowledge that we may only process withdrawal requests once identification and/or verification requirements have been satisfied by you.
5.16 All deposits, transfers and withdrawals will be monitored to prevent money laundering. We retain the right to make any queries regarding the source of any funds deposited with the Operator at any time. Should you fail to provide satisfactory responses to our queries, the Operator may suspend the Account and all Account functionality, including, but not limited to, Bet management and withdrawal of funds or close the Account. We may pass on such information, as we deem necessary, to the relevant authorities.
5.17 If within two weeks of a withdrawal request being made, the Operator is unable to verify your identity to its satisfaction, the withdrawal request will be cancelled and the funds returned to your Account.
5.18 If you owe us money for any reason, we shall be entitled to set off any such amount before making any payments or returning any money to you.
5.19 We hold customer funds separate from company funds in separate accounts which we hold with our regulated account provider.
5.20 Customer funds are not protected in the event of insolvency. This meets the British Gambling Commission’s requirements for the segregation of customer funds at the level: basic segregation.
5.21 We strongly advocate responsible gambling, please refer to section 12 for further information. If you feel that you are unable to control your gambling, tools such as deposit limits,, time-outs and self-exclusion are available and can be accessed via the in-App settings menu. To set a deposit limit click the ‘deposit limit’ link when first making a deposit or navigate to the ‘Deposit Limit’ page at any time via the in-App settings menu, then select a deposit limit and a time period. To set a time-out, navigate to the ‘Time Out’ page at any time via the in-App settings menu. To self-exclude from the App, navigate to the ‘Self-exclusion’ page at any time via the in-App settings menu, then select a time period.
6. Closure of your account
6.1 We or you may suspend or close your Account at any time for any reason. We reserve the right not to register an applicant and/or to suspend or terminate your use of our services at any time, and with no obligation to provide reasons for doing so.
Some of the reasons we may have for refusing to register or suspend/close an Account are:-
We are unable to complete our verification processes or have doubts about the accuracy or information provided to us;
We have knowledge or reasonable suspect you to be in breach of these Terms and Conditions;
We have knowledge or reasonably suspect that you are involved in match fixing, collusion with others or another form of cheating, or illegal/fraudulent activity, manipulation of software, exploitation of loopholes or other forms of abuse and in such instances we reserve the right to make a report with our regulator, the applicable sporting authorities, or any other appropriate authority;
We have knowledge or reasonable suspect that you have corrupted the Website with a bug, malware, virus, DDS attack or similar or have attempted to do so, and we reserve our rights to recover any losses incurred by us against you in full;
You become bankrupt or similar;
We have reasonable concerns that you have problems with your gambling.
You may close your account by contacting Customer Services. However, unless otherwise set out in these Terms and Conditions, this will not affect any Bets that have been sent, accepted by another User and confirmed by us but not yet determined. Such Bets will not be affected and will remain in force. Except as otherwise set out in these Terms and Conditions, we will return all of the funds in your Account following its closure.
6.2 If you breach any of the terms of these Terms and Conditions, we may immediately do any or all of the following (without limitation):
6.2.1 issue a warning to you;
6.2.2 temporarily or permanently remove any User Generated Content (as described in section 8.5) uploaded by you to the App;
6.2.3 temporarily or permanently withdraw your right to use the App;
6.2.4 suspend or terminate your Account;
6.2.5 issue legal proceedings against you for reimbursement of all costs resulting from the breach (including, but not limited to, reasonable administrative and legal costs);
6.2.6 take further legal action against you; and/or
6.2.7 disclose such information to law enforcement authorities as we reasonably feel it is necessary to do so.
6.3 If we withdraw your right to use the App, then:
6.3.1 Bets that have been sent, accepted by another User and confirmed by us but not yet determined will not be affected and will remain in force;
6.3.2 all rights granted to you under these Terms and Conditions shall cease;
6.3.3 you must immediately cease all activities authorised by these Terms and Conditions, including your use of any services provided through the App; and
6.3.4 you must immediately delete or remove the App from all Devices, and immediately destroy all copies of the App then in your possession, custody or control.
6.4 Following the suspension or closure of your Account for any reason we will return to you any surplus funds remaining in your Account, unless otherwise specified in these Terms and Conditions. We reserve the right (pending final determination of any issue, and following final determination in our favour) to withhold the return of funds if:
6.4.1 you have been involved in any fraudulent or dishonest activity or have breached the Terms and Conditions;
6.4.2 the applicable funds have been incorrectly credited to your Account, credited in error, or are winnings from Bets using funds incorrectly credited or credited in error; or
6.4.3 we are required to do so by law or to comply with the instructions of any competent court or governmental, regulatory or enforcement authority (wherever based).
6.5 Multiple Accounts with different email addresses, and/or different names, etc. for one individual person are not allowed. If, in our opinion, you have more than one Account (“Duplicate Account(s)”), we may elect at any time to: (i) keep your Account and Duplicate Accounts open; (ii) close your Account and all of your Duplicate Accounts; and/or (iii) keep open the first Account opened by you or on your behalf and delete all Duplicate Accounts. If we close any Account or Duplicate Account in these circumstances:
6.5.1 all bonuses, free Bets and winnings accrued from such bonuses and free Bets obtained using that Duplicate Account will be void and forfeited by you;
6.5.2 we may, at our entire discretion, void all Bets placed using funds in any Duplicate Account and refund to you the amount of any deposits made to the Duplicate Account (less any winnings withdrawn) and, to the extent not recovered by us from the relevant Duplicate Account, any amounts to be refunded to us by you in respect of a Duplicate Account may be recovered by us directly from any other of your Accounts (including any other Duplicate Account); or
6.5.3 we may, at our entire discretion, allow usage of the Duplicate Account to be deemed valid in which case all Bets placed by or for you through the Duplicate Account shall be retained by us and the balance of any amount remaining in the Duplicate Account which was deposited into the Duplicate Account by you (if any) will be refunded.
7. Inactive accounts
7.1 An inactive account is any Account that has been inactive for a period of twelve (12) months or more, meaning that you have not logged in for that period of time.
7.2 We may close any Account deemed to be an inactive account at any point after making such determination.
7.3 We will attempt to notify the User that an inactive account will be closed [thirty (30)] days before any such closure.
8. Using the App
8.1 You may use the App for lawful purposes only. You may not use the App:
8.1.1 in any way that breaches any applicable local, national or international law or regulation;
8.1.2 in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
8.1.3 to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
8.2 Accessing and/or using the App may be illegal in certain countries. You are responsible for determining whether your accessing and/or use of the App is compliant with the applicable laws in your jurisdiction and you warrant to us that gambling is not illegal in the territory where you reside.
8.3 You agree not to (and not to authorise any third party to):
8.3.1 infringe our intellectual property rights or those of any third party in relation to your use of the App;
8.3.2 rent, lease, sub-license, loan, translate, merge, reproduce, duplicate, copy or re-sell any part of the App (including but not limited to the personal information of other Users of the App);
8.3.3 access without authority, interfere with, modify, reverse-engineer, damage, disrupt or creative derivative works of:
(i) any part of the App;
(ii) any equipment or network on which the App is stored;
(iii) any software used in the provision of the App; or
(iv) any equipment or network or software owned or used by any third party, including any software you may need to download to use our services;
8.3.4 combine the App with, or incorporate it into in, any other programs;
8.3.5 misuse the App in any way, including without limitation by hacking;
8.3.6 do anything which hinders the performance of the App;
8.3.7 take any action to conceal or disguise the IP address of the device you are using to access the App;
8.3.8 infringe or attempt to infringe the privacy of another User of the App;
8.3.9 take any action to manipulate artificially the App, odds, feedback and/or ratings systems for whatever purpose;
8.3.10 transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the App;
8.3.11 use the App for the purposes of scraping, extracting or otherwise obtaining any material from the App for use within a third party website or application;
8.3.12 collect or harvest any information or data from the App or our systems or attempt to decipher any transmission to or from the servers running the App;
8.3.13 provide or otherwise make available the App in whole or in part (including object and source code) in any form to any person without prior written consent from us; or
8.3.14 comply with all technology control or export laws and regulations that apply to the technology used or supported by the App.
8.4 You acknowledge that you have no right to have access to the App in source-code form.
User Generated Content
8.5 If you supply/upload any content to the App – whether it be your personal information (for example username or email address) pictures, text, sound recordings or whatever – the content you supply ("User Generated Content") must comply with the following rules:
8.5.1 it must not be obscene, abusive, offensive or racist and it must not promote or condone hatred, violence, terrorism, illegal behaviour or physical harm against anyone;
8.5.2 it must not harass or bully another person;
8.5.3 it must be true and honest so far as you know;
8.5.4 it must not be defamatory of anyone;
8.5.5 it must not use the material or content or infringe the rights or privacy of anyone else; for example you should not use images of well-known characters, footage or music (unless it is your own); and
8.5.6 it must not contain someone else’s personal details or confidential information relating to other people.
8.6 We reserve the right to refuse to accept or refuse or cease to use any User Generated Content supplied by any person that we think contravenes these rules.
8.7 In addition, we may from time to time provide interactive services on the App that shall enable you to upload User Generated Content, including, without limitation:
8.7.1 comment facilities;
8.7.2 chat rooms; and/or
8.7.3 bulletin boards,
(together "Interactive Services").
8.8 Where we provide an Interactive Service, we will use reasonable endeavours to provide information to you about the kind of service offered and if it is moderated. However, we are under no obligation to oversee, monitor or moderate any Interactive Service we provide.
8.9 The use of any of our Interactive Services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an Interactive Service that it is important that they communicate with their children about their safety online. Minors who are using any Interactive Service should be made aware of the potential risks to them.
8.10 We do not guarantee that the App will be totally secure or free from bugs or viruses. You are responsible for configuring your information technology, Devices, computer programmes and platform in order to access the App and we recommend that you use your own virus protection software.
8.11 You must not misuse the App by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the App, the server on which the App is stored or any server, computer or database connected to the App. You must not attack the App via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit criminal offences. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the App will cease immediately.
8.12 You agree to inform us as soon as you encounter any errors in the App.
9. Placing Bets
9.1 We reserve the right to restrict, cancel or prevent all, or part, of any Bet requested at our sole and absolute discretion. All Bets are placed at your own risk and discretion.
9.2 A Bet is not valid until it has been accepted by another User and confirmed by us. Each valid Bet will be confirmed on the App, if you are unsure about the status of a Bet, you can check the status of all your Bets on the My Bets page. You will not be able to change or cancel the amount staked once your Bet has been accepted by another User. If both Users contact the App’s customer service team and both request to cancel a pre-match Bet that has been accepted and confirmed by us, and the match has not yet started, then such Bet will be deemed to be void and: (i) the customer service team will cancel the Bet on the App before the Bet is settled; or (ii) if the customer service team is not able to cancel the Bet on the App before the Bet is settled, the User with the successful Bet shall not be entitled to the winnings and all amounts placed on the Bet by both Users will be returned to the Users' Accounts as soon as reasonably practicable. No Bet accepted by another User can be cashed out.
9.3 In addition to 9.2 above, if Bets are placed via a credit or debit card they are not valid until we have received payment in full (even if they have been confirmed on the App). The Bet will be automatically void if we do not receive payment before the relevant event commences.
9.4 You may only place Bets on the betting markets provided on the App and Users cannot create custom markets. All Bets placed will be subject to the Wager Betting Rules. You acknowledge that we are entitled to take a commission from the total pot staked on an accepted Bet in accordance with the Wager Betting Rules.
9.5 You agree that you are solely responsible for all information (whether entered correctly or incorrectly) that you provide when placing a Bet, including the amount staked and the relevant event and that we have no liability to you or any third party in relation to any such information.
9.6 We reserve the right to suspend or cancel Betting on a market and/or cancel any Bet at any time prior to the determination of the Bet without notice (including, for example only, on the occurrence of a material event such as a goal being scored, penalty being awarded or player being sent off). When a market is suspended or cancelled it will not be possible to send or accept Bets on this market. If any Bets are sent or accepted, then these Bets will be voided.
9.7 Any ‘return’ of a Bet displayed on the App is for information purposes only, and settlement of all Bets will be calculated using the stake/risk at the odds accepted. You acknowledge that the odds for all Bets will be calculated using decimal odds. When converting from decimal odds to fractional odds, rounding errors may occur, in which case the App will display the nearest fractional odds.
9.8 We reserve the right to offer 'odds boosts' or to provide bonus funds to certain Users of the App on terms outlined in the Wager Betting Rules and/or any terms, conditions and rules of any special offers, promotions or bonuses which may appear on the App from time to time.
9.9 We may offer ‘in-play’ Betting in relation to some or all events, meaning that you may place a Bet after the start of the relevant event. The odds offered by us for Bets placed in-play may change (i) during the course of the event; and (ii) before the Bet has been accepted by another User. You should check the odds offered, the section of the Wager Betting Rules that determine the rules for fluctuating odds for in-play odds Bets and your Account settings before placing your Bet. The Bet will be automatically cancelled if the odds at the time the sending User sends the Bet differ from the odds at the time another User accepts the Bet by the amount outlined in the Wager Betting Rules. Further, you acknowledge that the App may not have the most up to date information available when betting on a live event and you may be at a disadvantage to operators or other customers who have more up-to-date information (including, for example, as a result of the broadcast of a 'live event' being delayed).
9.10 If the outcome of the event or match is known when a Bet is placed we reserve the right to void the Bet. Disputes over the times Bets are placed and/or accepted will be settled using our transaction log.
9.11 The placing of a Bet may be interrupted or prevented as a result of any hardware, software or network failure (for example, if your Device battery runs out, software malfunctions or your internet connection fails, or if the App or software fails for any reason). If this happens whilst you are placing a Bet, our records will be definitive evidence of whether or not the Bet was successfully placed before the failure. Our policy on service interruptions, as amended from time to time, is available
9.11.1 Where a service interruption is caused by failures in the gambling system, Cato Partners Limited will suspend betting on all betting markets that have been affected by a significant event before service is restored
9.11.2 Other failures should be dealt with fairly on a case-by-case basis
9.12 You are not permitted to engage in any unfair practices when placing Bets, including cheating or collusion, to confer an advantage on the User, or any other method of unfairly increasing your chances of winning. You declare that at the time you place a Bet, you have no knowledge as to the outcome of the respective events. Bets on events in which you have gained access to insider information are not allowed. Where there is a suspicion of a violation of this rule, the Operator retains the right to void the Bet and refuse to pay out winnings. It also retains the right to take any further action to protect its legitimate interests and to comply with other laws and regulations. If you think that a User is in breach of 9.12, you must inform us immediately at firstname.lastname@example.org.
9.13 We consider that unfair practices prohibited by 9.12 may include:
9.13.1 Users who display knowledge of insider information;
9.13.2 suspicious patterns of play (such as very frequent or very inconsistent betting patterns); and/or
9.13.3 unusual gameplay statistics.
9.14 The steps that we may take to prevent and/or detect unfair practices may include:
9.14.1 reviewing which User played against which other Users;
9.14.2 reviewing the amounts won from and lost to certain other Users;
9.14.3 reviewing activities on an individual Bet or individual action basis;
9.14.4 preventing a User from betting against other Users;
9.14.5 investigating players who display knowledge of insider information;
9.14.6 monitoring suspicious patterns of play (such as very frequent or very inconsistent betting patterns);
9.14.7 monitoring unusual gameplay statistics;
9.14.8 investigating customer complaints about unfair practices;
9.14.9 maintaining records of closed Accounts, including player details (name, location), scale of the potential breaches (financial and number of Users), time and date, the reason for investigation (including whether it was initiated by User contact), the outcome and any relevant further evidence such as reports, screenshots or chat history.
9.15 When placing a Bet, you are aware that you may be Betting against software applications such as bots or trading software.
9.16 We reserve the right in our sole discretion to withhold payment and to declare Bets on any event void if we have evidence that the integrity of the event has been called into question (including without limitation in relation to match fixing) and/or the price or market has been manipulated. Evidence of the above may (without limitation) be based on the size, volume or pattern of Bets placed with us across any or all of our betting channels. Any decision given by the governing body of the sport in question will be conclusive.
9.17 We reserve the right in our sole discretion to void the results of any Bet if we have reason to suspect that you have engaged in any unfair practices (including, for example only, cheating or collusion) or have otherwise breached these Terms and Conditions, any applicable law or the general principles and values of the App. Any such breaches or suspected breaches may result in us taking a range of actions against you including:
9.17.1 voiding the results of the Bet and recovering any winnings;
9.17.2 placing limits on your Account privileges including but not limiting to restricting your ability to place Bets;
9.17.3 suspension and/ or termination of your Account; and/or
9.17.4 reporting you to any relevant regulatory, investigatory or enforcement authority.
9.18 We reserve the right in our sole discretion to void the results of any Bet where (i) the outcome is already known when the Bet was placed; or (ii) the outcome of the relevant event cannot reasonably be determined. We will endeavour to contact the customer and explain decisions when voiding Bets.
9.19 We will contact the relevant Users via email in the case of any actual or suspected breaches of these Terms and Conditions, any applicable law or the general principles and values of the App. If you know of or suspect any such breaches then please report these directly to email@example.com.
10. Underage Users
10.1 It is a criminal offence to place a Bet if you are under 18 (or the legal age of gambling in the place where you are located). We take our responsibility to prevent those under 18 from placing Bets very seriously. If we are informed or otherwise become aware that you are under 18 or were under 18 when you placed any Bet then your Account will be immediately frozen whilst we investigate. Should we find that you are or were under 18 when you placed any Bet, we will refund to you any amounts deposited into your Account but will retain any winnings which you may have or are due to your Account, and you must pay us on demand any other winnings gained from Bets placed whilst you were underage.
10.2 The Operator would like to draw the attention of Users who are parents or have custody over children under 18 to parental responsibility over facilities such as mobile phones and tablets. Underage gambling is an offence and we reserve the right to report any underage Users to the police.
11. Verification Procedure
Before withdrawing funds from your Account, or at any point selected by us, or voluntarily by yourself, you will be required to satisfy our Know Your Customer ("KYC") procedure. Our KYC services provider will verify your details (for example, name, age & postal address) automatically by cross checking this information against the information on its databases. If the information that you have supplied is not sufficient to be verified by our KYC provider, then we will require you to provide the forms of identification required by our KYC provider to complete authentication. Our KYC provider will review these documents and, if satisfied, we will activate your Account. If our KYC provider is unable to fully identify you we will reject the submission and email you with assistance. More information on this process can be found in the help pages.
12. Responsible gambling and parental controls
12.1 We believe that gambling is an entertaining pursuit for responsible adults, and strive to provide a safe gaming environment on the App. For the minority of players who may have problems with gambling, we provide tools and information to help players identify problem gambling and limit or suspend their gambling with the Operator.
12.2 We provide:
12.2.1 a link to the deposit limit functionality when Users first deposit funds and also in the settings menu;
12.2.2 voluntary deposit limits set on a daily, weekly or monthly basis;
12.2.3 a voluntary time-out tool that customers block access to the app for 24 hours, one week, one month or any such other period as the customer may request, up to a maximum of 6 months
12.2.4 a voluntary self-exclusion tool that excludes Users for a minimum of six months;
12.2.5 links to other useful resources such as GamCare, a gambling help organisation; and
12.2.6 internal tools to prevent underage access.
12.3 We allow you to set daily, weekly or monthly deposit limits which enable you to voluntarily restrict the amount of money that can be deposited in a given period of time. You may change your limits at any time. However, requests to set or tighten the deposit limit will be processed immediately, while requests to relax or remove the deposit limit will be subject to a 24-hour waiting period before being processed.
12.4 If you feel that financial limits are not sufficient to control your gambling, we also allow you to voluntarily exclude yourself completely from the App, with a minimum exclusion period of six months. During the exclusion period, you may not log in, deposit funds or place Bets with the Operator. However, excluded Users are still permitted to withdraw any available funds from the Operator by contacting our customer services team. If you would like to self-exclude, please complete the Self Exclusion process under My Account . At the end of the self-exclusion period, if you would like to begin using the App again you must contact customer services at firstname.lastname@example.org. Requests to reactivate an Account at the end of a self-exclusion period will be subject to a 24 hour waiting period before being processed.
12.5 We take responsible gambling very seriously and if you try to open Duplicate Accounts with us during your period of exclusion we will do our best to detect and close them. If you are able to access our services, any losses incurred during the period before detection and closure of the Duplicate Accounts will not be refunded. We also reserve the right to withhold any winnings that have been obtained, with only the amount deposited returned to you.
12.6 Any winnings withheld will be donated to a responsible gambling charity of our choice.
12.7 We encourage Users who feel that they cannot control their gambling to utilise filtering software which will block access to gambling websites. 13. Intellectual property rights
13.1 We grant to you a non-transferable, non-exclusive, revocable licence to use the App on the Devices provided that you comply with these Terms and Conditions. We reserve all other rights.
13.2 We are the owner or the licensee of all intellectual property rights in the App and in the material published on the App. Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved.
13.3 You may print off one copy, and may download extracts, of any page(s) from the App for your personal reference.
13.4 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
13.5 Our status (and that of any identified contributors) as the authors of material on the App must always be acknowledged.
13.6 You are not granted any right to use, and may not use, any of our intellectual property rights other than as set out in these Terms and Conditions. You may only use the App for your own domestic, private and non-commercial use. You must not use any part of the materials on the App for commercial purposes without obtaining a licence to do so from us or our licensors.
13.7 If you print off, copy or download any part of the App in breach of these Terms and Conditions, your right to use the App will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
13.8 No part of the App, including, without limitation, the text, designs, graphics, photographs and images contained in it, may be copied, reproduced, republished, uploaded, re-posted, modified, transmitted or distributed or otherwise used in any way for any non-personal, public or commercial purpose without our prior written consent.
13.9 Any communications or materials (including, without limitation, any User Generated Content) you send to us through the App by electronic mail or other means will be treated as non-proprietary and non-confidential (other than communications in respect of your order if you use the App to buy products from us). We are free to publish, display, post, distribute and otherwise use any ideas, suggestions, concepts, designs, know-how and other information contained in such communications or material for any purpose, including, but not limited to, developing, manufacturing, advertising and marketing us and our products.
14. Our liability
14.1 We endeavour to ensure that the App is available to Users as much as is reasonably possible, but we cannot and do not guarantee that: (i) the App will be available at any specific time or for any specific period; or (ii) that the features, functionality or performance of the App or the services on it will meet your requirements or those of anyone else; or (iii) that the App or the services on it or the features and functionality of either of them are, or will be, compatible with, or available on, the device or system used by a player to access the App.
14.2 We shall be liable as expressly provided in these Terms and Conditions, but shall have no other obligation, duty or liability whatsoever in contract, tort (including negligence), breach of statutory duty or otherwise.
14.3 Nothing in these Terms and Conditions shall exclude or restrict our liability for death or personal injury resulting from our negligence or for fraud.
14.4 We shall not be liable for any loss or damage that may arise from the insolvency of any bank or payment provider, including (without limitation) any bank with which we maintain our accounts.
14.5 We shall not be liable for any loss or damage that may arise from any aspect of the App or its availability or functionality not within our reasonable control.
14.6 We shall not be responsible for any consequences resulting from major incidents such as any strike, terrorist activities, political crisis, war, and saturation of the telecommunication networks, natural catastrophe, or any other matter beyond our control; which could lead to a total or partial reduction, to the access to our services, on internet or by phone. In such an event, we may (in our sole and absolute discretion) cancel or suspend our services without incurring any liability.
14.7 Without limiting the Operator’s obligation to pay, transfer or credit winnings in respect of successful and valid Bets placed and accepted in accordance with these Terms and Conditions:
14.7.1 The Operator’s liability to any person at any given time shall not exceed an amount equal to:
(i) where the Operator’s liability relates to a Bet – the aggregate of the stake(s) placed by the User on the Bet(s) in respect of which the Operator’s liability has arisen;
(ii) where the Operator’s liability relates to the misapplication of funds – the amount of money which was in the User’s account which is misapplied by the Operator; and
(iii) in respect of any other liability of the Operator – an aggregate of five hundred pounds sterling (£500)]
14.7.2 The Operator will not be liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise for any loss that could not have been reasonably expected by the User and the Operator at the time of entering into these Terms and Conditions. Loss or damage would be reasonably expected by the User and the Operator if it is an obvious consequence of our breach or if it was contemplated by you and us at the time that you opened an Account with us, howsoever caused or arising, whether through non-supply or late supply of the App or any service available through it, non-performance of these Terms and Conditions or otherwise.
14.8 The Operator will not be liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise in respect of:
14.8.1 the refusal to allow any person to place a Bet in accordance with these Terms and Conditions; or
14.8.2 money lost by placing losing Bets; or
14.8.3 any losses caused arising from the misuse or unauthorised use of passwords; or
14.8.4 the corruption of data sent by you to us or by us to you.
14.9 Except as expressly stated elsewhere in these Terms and Conditions, all representations, warranties, conditions and other terms, whether express or implied (by common law, collaterally or otherwise) are hereby excluded, except in the case of fraud, or where such exclusion is not permitted by applicable law.
14.10 Nothing in these Terms and Conditions shall affect your statutory rights (which include, for example, that we will provide our services to a reasonable standard and within a reasonable time). 14.11 The App may contain inaccuracies or typographical errors. We make no representations about the reliability, availability, timeliness or accuracy of the content included on the App.

Where the App contains links to, or refers to URLSs of, other sites and resources provided by third parties, these links or URLs are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
17. General App Terms
For the purpose of this section, "Appstore Provider" means the provider of the app store through which you have downloaded the App (for example, Apple is the Appstore Provider if you have downloaded the App from the Apple App Store, Google is the Appstore Provider if you have downloaded the App from Google Play, etc).
17.1 You acknowledge and agree that these Terms and Conditions have been concluded between you and the Operator, and not with the Appstore Provider. You acknowledge and agree that the Appstore Provider is not responsible for the App and its content.
17.2 You acknowledge and agree that the Appstore Provider has no obligation to provide any maintenance or support in respect of the App. Should you have any problems in using the App, please contact the Operator at email@example.com.
17.3 In the event that the App does not conform with any product warranty provided for by these Terms and Conditions, the Appstore Provider may provide you with a refund of the price that you paid to purchase the App (if any). The Appstore Provider shall, to the maximum extent permitted by law, have no obligation to you whatsoever with respect to the App.
17.4 You acknowledge and agree that the Appstore Provider shall not be responsible for addressing any claims that you might have relating to the App, including (without limitation): product liability claims; any claim that the App fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection or similar legislation.
17.5 In the event that a third party claims that the App infringes its intellectual property rights, the Operator (and not the Appstore Provider) shall be solely responsible for the investigation, defence, settlement and discharge of such claim.
17.6 You warrant and represent that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
17.7 If the Appstore Provider is Apple, you acknowledge and agree that Apple and its subsidiaries are third party beneficiaries to these Terms and Conditions. Upon your acceptance of these Terms and Conditions, Apple will have the right to enforce these Terms and Conditions against you as a third party beneficiary.
18. Complaints and disputes
18.1 If you wish to raise any complaint with us, please email us at firstname.lastname@example.org. We will try to solve any disagreements quickly and efficiently. If a disagreement is resolved in your favour, we may (without limitation) reverse the transaction which is the subject of the disagreement.
18.2 If you are not satisfied by the response of our customer support team, you can ask for the dispute to be escalated to a manager or supervisor.
18.3 If we are unable to resolve any dispute relating to a gambling transaction between us, you may refer the dispute free of charge to the Independent Betting Adjudication Service (IBAS). 18.4 The English courts will normally have jurisdiction over any claim arising from, or related to, a visit to the App, unless you choose the courts of your home in a Member State of the European Union. We retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
18.5 As a consumer, if you are resident in the European Union and we direct this App to the Member State in which you are resident, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms and Conditions, including 18.6, affects your rights as a consumer to rely on such mandatory provisions of local law.
18.6 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by and construed in accordance with the law of England and Wales (or, if you live in another part of the United Kingdom, your local law).

19.1 We may revise these Terms and Conditions at any time by posting an amended version on the App. If we update the terms of these Terms and Conditions, the updated terms will apply to each of your uses of the App from that point on. Some of the provisions contained in these Terms and Conditions may also be superseded by provisions or notices published elsewhere on the App. We will use reasonable efforts to ensure that any important changes will be notified to you by an appropriate method, such as a notice on the App. However, it is your responsibility to check the Terms and Conditions regularly to take notice of any changes we make, and you agree to do so. Any changes to the Terms and Conditions are binding on you from the first time you visit the site after the relevant change. If you do not agree with any changes or additions we make, please refrain from using the App.
19.2 From time to time updates to the App may be issued through the relevant app store. Depending on the update, you may not be able to use the App until you have downloaded the latest version of the App and accepted any new terms.
19.3 You will be assumed to have obtained permission from the owners of any Devices that are controlled, but not owned, by you to download a copy of the App onto the Devices. You and they may be charged by your and their service providers for internet access on the Devices. You accept responsibility in accordance with the terms of these Terms and Conditions for the use of the App or the Services on or in relation to any Device, whether or not it is owned by you.
You may not assign or transfer any of your rights or obligations under these Terms and Conditions. We may at any time and in our sole discretion assign or transfer any of our rights or obligations under these Terms and Conditions to any member of our group (which means our subsidiaries, our ultimate holding company and its subsidiaries) and/or to any third party in conjunction with the transfer of all or part of our business and assets. We will inform you of any transfer and assignment of a contract, whether in full or in part, on the App. By using the App and/or placing a Bet on your next visit, you indicate that you accept the transfer and/or assignment.
If we fail to insist that you perform any of your obligations under these Terms and Conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
22.1 Each of the provisions of these Terms and Conditions operates separately. If any provision (or part of a provision) of these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in full force and effect.
22.2 If any invalid, unenforceable or illegal provision would be valid, enforceable or legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the commercial intention of the parties.
23. Whole agreement
23.1 These terms and conditions represent the whole of the agreement between us and you, and replace any previous written or verbal agreement, communicated by or to us.
24. Third party rights
24.1 Except where expressly otherwise provided, these Terms and Conditions are between, and are not intended to give rights to anyone other than, you and us and do not create any third party beneficiary rights. No third party will have any rights to enforce any provision of these Terms.
